The Statement Mangala Samaraweera Made To The Police

‘It has been brought to our notice that in the wee hours of 9th January there has been a serious attempt by Hon. Mahinda Rajapaksa and brother Gotabhaya Rajapaksa, former Defence Secretary, Mohan Peiris, Chief Justice, G.L. Peiris, and one Udaya Gammanpila have been discussing and conspiring to subvert the due process of law when the results of the Presidential election were becoming known, which were not favourable to one of the candidates, namely Hon. Mahinda Rajapaksa.’

RE: CONSPIRACY TO SUBVERT THE DEMOCRATIC PROCESS

I am making a complaint in a matter of national importance and public security.

It has been brought to our notice that in the wee hours of 9th January there has been a serious attempt by Hon. Mahinda Rajapaksa and brother Gotabhaya Rajapaksa, former Defence Secretary, Mohan Peiris, Chief Justice, G.L. Peiris, and one Udaya Gammanpila have been discussing and conspiring to subvert the due process of law when the results of the Presidential election were becoming known, which were not favourable to one of the candidates, namely Hon. Mahinda Rajapaksa. The discussions were based around an attempt to impose a state of emergency under the Public Securities Ordinance. It is also revealed that in order to facilitate this process, orders were sent to a large number of military officers from the Panagoda Cantonment through Gotabhaya Rajapaksa with a view to prevent the elections results from being released with the imposition of a state of emergency and planned to continue in office by unlawful and illegal means with the help of the military.

It is also known that Hon. Attorney General Yuvanjan Wijayatilake had been summoned to Temple Trees at about 3.00 am by Hon. Mahinda Rajapaksa when the above named persons were present. However Attorney General Wijayatilake has refused to contrive with the coup attempt to impose a state of emergency and continue in office by unlawful and illegal means with the help of the military. Upon being summoned, the Attorney General had called the Solicitor General Mrs. Bimba Thilakaratne, and informed her that he had been summoned to Temple Trees by Hon. Mahinda Rajapaksa.

We also understand that Hon. Mahinda Rajapaksa has solicited the support of the IGP Mr. N.K. Illangakoon, and the Army Commander Lt. General Daya Ratnayake. We aware that both these officers have declined to participate in the coup attempt of Mahinda Rajapaksa, Gotabhaya Rajapaksa, Mohan Peiris, GL Peiris and Udaya Gammanpila. The aforesaid unlawful conduct constitutes very serious offences against the State and its security.

Therefore I am making this complaint for an immediate investigation and further action to be taken as required by law.
