Amendments Proposed to the Constitution by Devananda EPDP MP

1. to add immediately after Para. 41A. (1) (e) of the Gazetted Nineteenth

Amendment to the Constitution bill

” and out of the five persons appointed one person shall be a Tamil and another person a Muslim. “

2. to delete the following sentence in Para. 41b. (3) of the Gazetted Nineteenth Amendment

to the Constitution bill,

“to ensure that such recommendations reflect the pluralistic character of Sri Lankan society”,

and to insert the following sentence,

“to ensure that such recommendations reflect the ethnic composition of Sri Lankan society”.

3. to add in the Schedule in Chapter VII A (The Constitutional Council) of the Gazetted

Nineteenth Amendment to the Constitution bill, the following after (k)

(l) The Commission for Ethnic and Religious Harmony.

4. to add a new “Chapter XIX C” under the caption ” The Commission for Ethnic and

Religious Harmony” in the Gazetted Nineteenth Amendment to the Constitution bill.

The power and functions of ” The Commission for Ethnic and Religious Harmony”

should be in line with the “Ethnic Relations Commission” of Guyana established

under Constitutional Amendment Act of 2000, and with powers to investigate and

prosecute complains of racial discrimination.

5. to add the following sentence immediately after Par. 107 (1) of the Constitution of

the Democratic Socialist Republic of Sri Lanka,

” and the President in appointing the Judge of the Supreme Court and Court of Appeal shall

ensure that at least one Tamil and one Muslim are amongst the sitting Judges of the

Supreme Court and Court of Appeal.”

(This clause is brought in view of the practical difficulties encountered by the Supreme Court

and Court of Appeal Judges in dealing with the appeals coming from the Northern and

Eastern Provinces, where the language of court record is Tamil.)
